Many of our clients want to know, “will I have to go to trial for my personal injury claim in Orange County, California?” That really depends on what happens with your actual case and how the insurance company responds. When you work with DKB lawyers, you can expect straight talk and sound legal advice.  If we think that the settlement offer is fair we will let you know.  If it appears too low, we may recommend that you go to court instead.

Contested Case

Insurance companies make more money by minimizing their liability.  In this case, that means paying as little as possible for your injury claim. One of the ways that they do so is by trying to push blame in your direction.  If they can make it appear that you were negligent and to blame for the accident, they may not have to pay anything or perhaps they will pay very little.  In this situation, there is a very high likelihood that you will end up needing to go to court because they may not offer to settle at all.

Denied Medical Claims

Another reason to go to court is if the insurance company is denying your access to critical medical care.  If your doctor recommends that you have surgery or a more intensive procedure than what the insurance company wants to pay for, you don’t have to accept it.  You can go to court and make a case for why you need to have it and how your health will improve as a result.  This is something that we can assist you with as a personal injury law firm.

When will I know if I will I have to go to trial for my personal injury claim?

You typically will not know immediately.  The case generally begins with research and gathering evidence, working with your doctor and valuing your claim.  Once the lawsuit is filed, there may be settlement negotiations and at this time we will know whether or not they are going to make a fair settlement offer.  This is when we will make a recommendation regarding whether or not you should go to court or take the deal. However, if there are any disputes over medical claims or property damage they may arise sooner.

If a lawyer recommends court, will I have to go to trial for my personal injury claim?

No.  You can make the decision regarding how to proceed with your case.  If you would prefer to accept the insurance company’s settlement offer it is within your right to do so.  Even with an attorney, you are in control of your case. At Kohan & Bablove, our job is to advise you but the ultimate decision will always remain with you.
